What Is Wrongful Death?

A wrongful death occurs when a person dies because of the negligent, reckless, or intentional act of another. Common examples include a fatal crash caused by a drunk or distracted driver, a deadly truck accident, a pedestrian killed in a crosswalk, a fatal fall caused by an unsafe property, a death caused by defective products, or fatal medical negligence. In each case, the wrongdoer can be held financially responsible to the surviving family members and the estate, even if the same conduct also leads to a separate criminal case.

Who Can File a Wrongful Death Lawsuit in Nevada?

Nevada’s wrongful death statute, NRS 41.085, identifies who may bring a claim. The personal representative of the deceased person’s estate may file on behalf of the estate, and the deceased’s heirs — typically a surviving spouse, children, and in some cases parents — may file for their own losses. The heirs may recover for their grief and loss of companionship, while the estate may recover certain damages such as the deceased’s medical and funeral expenses. We help families understand exactly who has the right to file and how any recovery is divided.

Damages in a Wrongful Death Claim

Compensation in a Nevada wrongful death case may include funeral and burial expenses, the medical bills incurred before death, the financial support and benefits the family would have received over the deceased’s lifetime, and the heirs’ grief, sorrow, and loss of the love, companionship, comfort, society, and guidance their loved one provided. When the death resulted from especially egregious or malicious conduct — such as a drunk driver — punitive damages may also be available to punish the wrongdoer and deter similar conduct.

Time Limits — Act Before the Deadline Passes

Nevada generally gives families two years from the date of death to file a wrongful death lawsuit under NRS 11.190. Claims involving a government entity can carry much shorter notice deadlines. While the last thing any grieving family wants to think about is a legal deadline, speaking with a lawyer early protects your rights and allows critical evidence to be preserved while it still exists. A free, no-pressure consultation costs nothing and creates no obligation.

Frequently Asked Questions

Who can file a wrongful death lawsuit in Nevada?

Under NRS 41.085, the personal representative of the deceased’s estate and the deceased’s heirs may file. Heirs typically include a surviving spouse, children, and sometimes parents. Heirs can recover for their own losses, such as grief and loss of companionship, while the estate can recover damages like funeral costs and pre-death medical expenses. We help determine who has standing in your specific situation.

What is an example of wrongful death?

3
2

Examples include a loved one killed by a drunk or distracted driver, a pedestrian fatally struck in a crosswalk, a worker or guest killed by a dangerous condition on someone’s property, a fatal commercial-truck collision, or a death caused by a defective product or medical negligence. If a person died because someone else was careless or reckless, it may be a wrongful death.

What is the negligence rule in Nevada?

3
2

Nevada follows a modified comparative negligence rule under NRS 41.141. A family can still recover in a wrongful death case as long as the deceased was not more than 50% at fault for the incident, though the award is reduced by the deceased’s percentage of responsibility. Insurers often try to shift blame onto the victim to reduce what they pay, which is exactly why experienced representation matters.

What is the statute of limitations for wrongful death in Nevada?

3
2

Generally two years from the date of death under NRS 11.190. Shorter deadlines can apply to claims against government entities, and limited exceptions may change the timeline in unusual cases. Because missing the deadline can permanently bar your claim, it is important to speak with a Las Vegas wrongful death lawyer as soon as possible.
